Overview

Kevin Attridge practices in Stein Mitchell’s Commercial Litigation and Whistleblower groups.  Over the years, he has represented the likes of tech executives, Am Law 100 law firms, A-list movie stars, global construction firms, and leading music labels.  Kevin has advised his clients in a wide range of matters in arbitration and before federal and state courts involving copyright infringement, defamation, professional liability, data security, megascale construction, government contracting, and health care fraud.

Prior to joining Stein Mitchell in 2013, Kevin litigated antitrust, telecommunications, securities, and class action matters at a prominent Washington, D.C. law firm.

Experience

  • UMG Recordings, Inc., et al. v. Grande Communications Networks, LLC (Western District of Texas): Trial counsel for leading music recording companies in large-scale copyright infringement suit against an internet service provider. After a month-long trial, won a $46.8 million willful infringement jury verdict for the recording companies. Earlier in the case, obtained summary judgment against the ISP’s safe harbor defense under the Digital Millennium Copyright Act, a ruling cited in numerous copyright cases and authorities.
  • Patrick K. Donnelly v. ProPharma Group (District of Delaware): Trial counsel for pharmaceutical consulting services company in breach of contract suit brought by a former board member, seeking millions in claimed compensation. After a four-day jury trial, secured a complete defense verdict.
  • UMG Recordings, Inc., et al v. RCN Telecom Services, LLC (District of New Jersey): Counsel for leading music recording companies in large-scale copyright infringement suit against the sixth largest internet service provider in the country.
  • John C. Depp II, et al. v. Bloom Hergott (Los Angeles County Superior Court): Counsel for actor Johnny Depp in legal malpractice and breach of fiduciary duty suit against his former entertainment lawyers. Obtained judgment on the pleadings in Mr. Depp’s favor on defendants’ counterclaims and secured an eight-figure settlement for Mr. Depp.
  • Commercial Arbitration Matter:  Trial counsel for leading engineering, procurement and construction contractor in a large commercial arbitration involving claims of over $1 billion brought by leading energy utility company regarding a $3.5 billion power plant project. Secured complete defense award for client after arbitration hearing conducted over two months.

  • Affinity Gaming v. Trustwave (District of Nevada): Represented Affinity Gaming, a U.S. casino company, in a lawsuit against Trustwave, the data security company Affinity Gaming hired to investigate and remediate a data breach. Affinity Gaming alleged that Trustwave misrepresented its investigation and the security of Affinity Gaming’s data.

  • Companion Data Services, LLC v. SRA International, Inc. (District of South Carolina): Represented government contractor in a dispute over a multi-million-dollar software sale.
