Vindicating Medical Device Client
When our client asserted valuable intellectual property against a competitor, we were sued for breach of contract, trade secret misappropriation, various other torts, and declarative judgment attempting to invalidate our patent.
We secured dismissal of the breach of contract and other claims, and then obtained a serious of favorable discovery rulings, culminating in an award of sanctions against our opponent. Shortly after this sanction award, the plaintiff agreed to a favorable settlement for our client that included a consent order finding our patent valid and infringed.
