Stein Mitchell secures preliminary injunction against unconstitutional West Virginia law on behalf of the International Association of Color Manufacturers (“IACM”)

On December 23, 2025, the United States District Court for the Southern District of West Virginia granted Stein Mitchell’s motion for preliminary injunction filed on behalf of the IACM, enjoining enforcement of West Virginia H.B. 2354. Through this statute, West Virginia sought to ban certain FDA-approved color additives used safely for years in food and beverages.  Stein Mitchell had filed the IACM’s complaint and preliminary injunction motion on October 6, 2025. The state opposed, and after the motion was fully briefed, the Court issued its ruling, agreeing with the IACM that the law was unconstitutionally vague and therefore violated the Due Process protections of the federal and state constitutions. The suit is captioned International Association of Color Manufacturers v. Arvin Singh, et al., No. 1:25-cv-00588, filed in the United States District Court for the Southern District of West Virginia.
