Stein Mitchell represented a leading North American institutional review board in litigation related to its review and approval of an FDA-regulated clinical drug study.  The plaintiff alleged that the institutional review board was liable for the unfortunate death of a study participant—a novel theory of liability.  After limited discovery, we secured the dismissal of all claims at summary judgment following extensive briefing and lengthy oral arguments.  We also secured denials of various motions brought by the plaintiff to add new claims and for reconsideration of the court’s entry of summary judgment.  Plaintiff chose not to file an appeal.
